These terms apply when you purchase products from www.amsmartshops.com. Please read them before placing an order.

1. Using our website

You must provide accurate information when placing an order and use the website lawfully. You must not interfere with the website, attempt unauthorised access to our systems, or use false payment information.

You must be at least 18 years old to place an order. Some products may have additional age or eligibility requirements, which we will explain where applicable.

2. Products and information

We take reasonable care to describe and display our products accurately. Packaging, colours and product details may occasionally change. Please read the packaging, labels, warnings and instructions supplied with a product before using it.

We sell products only where we are entitled to do so and may apply any checks required for particular products.

Product sourcing and brand independence

We source products through a range of supply channels, which may include distributors, wholesalers and other independent retailers. Unless expressly stated on a product page, AM SmartShops is an independent retailer and is not an authorised dealer, appointed distributor or affiliate of the brands whose products we sell.

Brand names and trademarks are used to identify the products offered for sale and remain the property of their respective owners. We aim to supply genuine products in the condition and specification described on each product page.

3. Prices and payment

Prices are shown in pounds sterling. The total price, including any applicable delivery charge, will be displayed before you place your order.

We may change prices at any time, but a change will not affect an order we have already accepted. If we discover an obvious pricing or product-information error before accepting an order, we may decline the order and let you know. If payment has been taken, we will refund it.

You can pay using the methods displayed at checkout. Payment processing is carried out by our payment providers.

4. Placing an order

When you place an order, we will send an acknowledgement to the email address you provide. An acknowledgement confirms that we have received your order; it does not necessarily mean that we have accepted it. A contract is formed when we confirm acceptance or dispatch the goods.

All orders are subject to availability and any applicable product requirements. If we cannot fulfil an order, we will contact you and refund any amount paid for the unavailable goods. We may refuse an order where we reasonably suspect fraud or where fulfilling it would be unlawful.

5. Delivery

Available delivery options, charges and estimated times will be shown at checkout. We will deliver to the address provided with your order. Please check that it is correct.

We will deliver within the agreed period or, if no period has been agreed, without undue delay and within 30 days after the contract is made. If delivery is delayed or fails, your legal rights remain unaffected. Please contact us so we can investigate and resolve the problem.

The goods remain at our risk until they are received by you or someone you have identified to receive them. The law provides a different rule if you independently arrange a carrier that we did not offer as a delivery option.

6. Cancelling an order and returning goods

For most online purchases, you have a legal right to cancel within 14 days after receiving the goods, without giving a reason. You then have a further 14 days to return them. Certain legal exclusions may apply, including to qualifying sealed goods that become unsealed after delivery for health protection or hygiene reasons.

7. Faulty or misdescribed goods

We are under a legal duty to supply goods that conform to the contract. Goods must be of satisfactory quality, fit for purpose and as described. If something is wrong with your order, contact info@amsmartshops.com with your order number and details so we can help.

Your rights under the Consumer Rights Act 2015 apply regardless of any manufacturer’s warranty or any change-of-mind returns exclusion.

8. Our responsibility to you

We are responsible for losses you suffer that are a foreseeable result of our breach of these terms or our failure to use reasonable care and skill. We do not exclude or limit liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud, or your statutory rights relating to goods.

We do not promise that the website will always be available without interruption. This does not affect our obligations concerning any order we have accepted.

The website’s text, layout, branding and other content may be protected by intellectual property rights belonging to us or our licensors. You may use the website for personal shopping purposes. Please do not copy or commercially exploit its content without permission.
